Rental Terms and Conditions (St.Thomas True Car Rental abbreviation TCR)

THESE TERMS AND CONDITIONS CONTAIN A BINDING ARBITRATION CLAUSE AND CLASS ACTION WAIVER THAT IMPACT YOUR RIGHTS ABOUT HOW TO RESOLVE DISPUTES. PLEASE READ THIS PROVISION CAREFULLY.

  1. The Rental Agreement                                                                                                                                                                                                 These Rental Terms and Conditions, the rental document you receive when you are given access to the car you are renting (the "Rental Contract") any additional agreement signed by you, any documents or agreements (or links to on-line documents or agreements) sent to you electronically in connection with your rental), the Privacy Notice, and the return receipt or record (the "Rental Receipt") with computed rental charges  together constitute the "Rental Agreement" between yourself and St.Thomas True Car and Sales LLC (TCR). You agree that this Rental Agreement is binding and enforceable upon signature and acceptance of the vehicle.
  2. Your Rental                                                                                                                                                                                                                         You rent from TCR the car described on the Rental Contract, which rental is solely a transfer of possession and not of ownership. You agree to the terms in the Rental Agreement provided any such term is not prohibited by the law of a jurisdiction covering this rental, in which case such law controls. This Agreement does not create an agency, partnership, or any other relationship beyond a rental contract. “You” and “your” refer to the person who signs this agreement, “we”, “our” and “us” refer to TCR. You agree not to assign, delegate, or transfer your obligations under this Agreement to any other party.

RENTER’S QUALIFICATIONS

  • Renter must be aged 21+. All renters (Main driver and additional drivers) must produce a valid Driving license with their name when pick up the car. All drivers must have a safe driving record and driving license must have been current for at least one year. You agree to provide accurate and current identification and will be liable for any misrepresentations regarding age, identity, or driving eligibility.
  • A Domestic/International Driving License.
  • The main driver must be in possession of a Credit Card in their own name when picking up the car. You agree to provide accurate and current identification and will be liable for any misrepresentations regarding age, identity, or driving eligibility.
    The main driver must be in possession of a credit card in their name when picking up the car. The card must have sufficient available funds to cover the rental deposit, local fees, and any additional purchases.

ACCEPTABLE FORMS OF PAYMENT

  • MasterCard
  • Visa
  • AMEX
  • Debit Cards $500.00 or more hold        TCR accepts Visa, MasterCard, and AMEX credit cards. Debit cards are accepted with a $1,000 hold. A 10% additional charge will be added to your rental transaction total. By signing this Agreement, you authorize TCR to charge your card for rental fees, damages, or any additional fees incurred during or after the rental period.
  • By entering into this rental agreement, the renter agrees that St. Thomas True Car Rental (TCR) may charge an initial amount of $300 to their credit card. The renter further agrees that this amount may be applied to cover any costs related to the rental, including, but not limited to, charges for an empty gas tank, damages to the vehicle, applicable deductibles, or any other rental-related expenses. The renter acknowledges and agrees that additional charges may be applied beyond the initial $300 deposit if necessary, as itemized in the final invoice.

"10%  additional charge will be added to your car rental transaction total.

INSURANCE

Standard Insurance

TCR Insurance: TCR maintains insurance for all vehicles, but this insurance only applies if the renter fails to provide valid personal insurance. TCR’s insurance is secondary and limited. It is not intended to cover all costs and includes $2500 deductible to be paid by renters. Any expenses beyond TCR’s insurance limits are the renter’s full responsibility.

Primary Insurance Requirement: Renters must provide proof of their own full coverage insurance (liability and collision) issued by a U.S. insurance company, valid for use in the U.S. Virgin Islands. Credit card insurance and travel insurance are not accepted as sufficient coverage.

Proof of Insurance: You must present proof of your personal insurance when picking up the vehicle. It is your responsibility to confirm with your insurer that your policy covers rentals in the U.S. Virgin Islands. A verification letter from your insurance company may be required.

Acknowledgment: By signing this agreement, you confirm that you understand and agree that TCR’s insurance is a backup option only, with limited coverage. You accept full responsibility for any costs, damages, or claims that exceed the limits of TCR’s insurance.

MILEAGE / KILOMETRES Unlimited Mileage

ADDITIONAL DRIVERS No Charge of additional driver over 24.

FUEL CHARGE

  • All vehicles are provide with a full tank of fuel at the time of rental, and must be returned with the tank refilled. Otherwise, the specified refueling charge will be applied.
  • The refueling charge is twice the amount you would pay at the pump.

.LOST/DAMAGE KEY CHARGE

  • Electronic Keys cost $350.00 to replace the key charge will be applied. Do not get keys wet, as this will void them, and you will be responsible for replacement.

SPECIAL CLEANING FEE

  • If the renter smoke in the car, or the car is dirty or has an unpleasant smell and cannot be cleaned in the usual way, the must pay a fine of $250.00. This includes ordor of pets and pet hair. 

OTHER FEES

  • If the renter incurred any charges, such as speeding tickets or unpaid congestion charges, TCR will try to contact the renter. This could be months after the rental – and the renter have to pay these administration fee as well as the original charge. Please be aware that all cars have a non-smoking policy. Fines will apply if this policy is not adhered to.
  • At the time of rental, a charge equal to the estimated amount of the rental plus a $300.00 - $2,000.00 Security Deposit is required. All deposits are refunded after the rental car is returned undamaged, and all incidental fees are paid.

ARRIVAL DETAILS 

  • Flight Details – If you are arriving by plane, you must inform us of your arrival flight number at least 3 days before your rental is due to start. If you do not, we cannot be held responsible if your plane is delayed and as a result your car is not available. Please ensure that you enter your flight number and not any other number the airline may have sent you, such as a confirmation number.

OUTSIDE OFFICE HOURS

  • If you require the car to be available outside of normal office hours, whether for the pick-up or the drop-off, TCR will arrange for a member of staff to be available. Prior notification is required for this service and it will incur a fee to cover additional man hours.
  • The cost of this service is $10.

DELIVERIES AND COLLECTIONS

  • If requested in advance, TCR may agree to deliver the car at the start of the rental. The cost will be paid to TCR on signing the rental agreement.
  • The cost of this service will be confirmed after you have made the booking and we have confirmed that this would be allowed.

RENTAL PERIOD

  • TCR will allow a grace period of 30  minutes when returning your vehicle. Extra hours will be charged at one fourth of daily rate.

EXTENSION OF RENTAL

  • Should the renter wish to extend the rental beyond the agreed return date, it is very important that the TCR rental office be advised immediately so that the insurance coverage will be extended. Failure to do so will mean that the renter is driving the vehicle without insurance coverage.

CANCELLATIONS, NO SHOWS & AMENDMENTS

Cancellation Pay on Arrival Bookings

  • There is no cancellation fee for Pay on Arrival.

Cancellation of Fully Prepaid Bookings

  • If you cancel 48 hours or more before your rental is due to start, we will refund the full prepaid amount, less a $150 processing fee.
  • If you cancel less than 48 hour’s period before pick-up time, the entire prepaid amount will be forfeited.
  • In the case of the customer requesting to postpone the travel date, when the original travel schedule has passed and notify the cancellation later. The company reserves the right not to refund according to the conditions (must cancel 48 hours or more from the original car rental time).
  • In the event of a flight cancellation, due to weather conditions or other measures beyond your control, TCR will not charge fee as long as a flight number and airline were provided in the reservation prior to scheduled pickup.
  • If you return the vehicle before the original return date (early return), you will not be refunded any portion of the payment.
  • If you fail to turn up at the agreed time and date, and/or to provide all the necessary documentation, and/or to provide a credit card with enough available funds on it, the TCR may refuse you the car.
  • If you return the vehicle before the original return date (early return), you will not be refunded any portion of the payment.
  • Upon returning the vehicle, TCR will process a release of the unused portion of the hold taken at the time of pickup subject to your bank’s procedure. This hold may take up to two weeks to be released by your bank.
  • All reservations booked with TCR require a non-refundable $150 pre-payment UNLESS one (1) of the following conditions are true during your rental dates
  • Your vacation is cancelled due to travel restrictions imposed by the US Virgin Island (USVI) government.
  • St. Thomas airport closure due to hurricanes or other tropical weather.
  • IF your reservation meets one (1) of the criteria above, your options are
  • Apply the $150 towards any future reservation
  • Receive a full refund of your $150 pre-payment
  • Does not apply to previously canceled reservations

No-Show

A ‘No-show’ is when you:

  • Wish to cancel but don’t tell us before your rental is due to start, or
  • Fail to pick the car up at the arranged time and date, or
  • Fail to provide the documentation that’s required to pick the car up, or
  • Fail to provide a credit card in the main driver’s name with enough available funds on it.

In all of these cases, you’ll receive no refund of the money you’ve paid. TCR reserves the right to refuse the rental with no refund.

In case of a no-show, the original booking conditions will only be maintained for 12 hours.

  • TCR reserves the right to refuse the car to any customer who fails to arrive on time with all necessary documentation and a credit card with enough available funds for the car’s rental fee. In such a case, unless the rental has been cancelled in advance, the customer will not be entitled to a refund.

RENTAL RESTRICTIONS

You may not use your rental vehicle:

  • Off road or on roads unsuitable for the vehicle (including racetracks).
  • When it is overloaded with passengers and/ or baggage.
  • To haul/tow, push or pull any vehicle, trailer or other objects and carry surf boards (without written permission from TCR).
  • To carry anything which may harm the vehicle (explosive or combustible materials Example Fuel Jugs that had or have fuel inside) or delay our ability to rent the vehicle to the next customer (because of its condition or smell).
  • To smoke inside or for any illegal purpose.
  • To transport pets or animals (unless in writing from TCR)
  • To sit on the roof top or the hood of the vehicle.
  • To carry passengers in the trunk area of the vehicle.
  • To Drive on a beach, which will cause damage by salt water and/or sand.
  • If anyone inside is standing, No standing is permitted while the vehicle is in motion

*If you do not comply with these Rental Restrictions:

  • You will be responsible for any damage(s), losses and expenses we suffer as a result.
  • We may terminate your Rental Agreement and take the vehicle back at any time, at your expense.
  • Violation of these restrictions will result in termination of the rental agreement, and you assume all financial responsibility for damages.

     IMPORTANT INFORMATION

  • To make sure you understand the rules and laws about driving in the USVI, it’s essential you read the Terms & Conditions in full before you leave to pick your car up.
  • In particular, please make sure you know what documents and other paperwork you must take with you (e.g. driving license, forms of identification, and payment cards) and what you’ll need to pay for at the rental counter. If you don’t have everything you need, our rental staff may not let you pick the car up.
  • By making this booking, you are confirming that you have read and accept our Terms & Conditions.
  • When you pick your car up, our rental staff will need you to sign a rental agreement. Please make sure you read it carefully – and if anything is not clear, discuss it with our rental agent before you sign.
  • If you are dissatisfied with any aspect of your rental, it’s very important you discuss this at the time with our rental agent. If you are not satisfied with their response, please visit our Contact Us page and tell us about it. If you have any questions or any issues, please don’t hesitate to contact us.
  • All rentals are subject to the standard terms and conditions provided with the Rental Agreement.

IN THE EVENT OF AN ACCIDENT

1. Immediate Notification: In the event of an accident, the renter must:

Call the police (911) immediately to report the accident and obtain an official police report.
Contact St. Thomas True Car Rental LLC (TCR) as soon as possible to notify us of the accident and provide all relevant details.
2. Payment of Estimated Damages:

The renter agrees to pay TCR an estimated amount for damages before the vehicle return date listed in this Rental Agreement.
If an immediate damage estimate cannot be obtained due to weekend, holiday closures, or other delays, the renter agrees to pay a minimum deposit of $1,500 (or more, depending on insurance deductible requirements) until a final damage estimate is available. If the actual repair cost is less than the deposit amount, TCR will refund the difference to the renter.
3. Assumption of Financial Responsibility:

The renter agrees to assume full financial responsibility for any and all costs exceeding the limits of any applicable insurance coverage. TCR’s insurance, if applicable, is strictly secondary, and TCR will not be liable for costs beyond this coverage limit.
4. Indemnification and Liability Waiver:

The renter agrees to defend, indemnify, and hold TCR harmless from any claims, lawsuits, or expenses (including attorney fees) arising from the renter's use or operation of the rental vehicle, including claims resulting from the renter’s negligence, misconduct, or breach of this Agreement.
The renter is also responsible for covering lost rental income for each day the vehicle is out of service for repairs.
5. Litigation and Dispute Resolution:

All disputes arising from or relating to this Rental Agreement or any incident involving the rental vehicle must be litigated exclusively in the courts of the U.S. Virgin Islands. Each party will bear its own attorney fees. TCR reserves the right to act at its sole discretion in any dispute.
6. Cooperation Requirement:

The renter agrees to fully cooperate with TCR regarding any matters related to the accident, including providing documentation, executing any necessary documents, attending hearings, and giving testimony under oath if required. The renter agrees to take any reasonable actions TCR requests in connection with:
This Rental Agreement,
The use and return of the vehicle, or
Any legal or insurance matters resulting from the accident.

7. Third-Party Liability and Responsibility

  • You acknowledge and agree that you are fully responsible for any claims or damages involving third parties (e.g., other drivers, pedestrians, property owners) resulting from your use of the rental vehicle. TCR is not responsible for any third-party damages or injuries caused by you or additional drivers listed on this Agreement.

8. Indemnification and Waiver

You shall defend, indemnify, and hold us, harmless from all losses, liabilities, damages, injuries, claims, demands, awards, costs, attorney fees, and other expenses incurred by us in any manner from this rental transaction or from the use of the car by you or any person, including claims of, or liabilities to, third parties. You agree to defend, indemnify, and hold TCR harmless from any claims, demands, or expenses due to your use of the vehicle, including third-party claims. Final responsibility rests with the renter, even if TCR’s insurance provides temporary coverage.YOU WAIVE ANY CLAIM AGAINST US FOR INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES IN CONNECTION WITH THE RENTAL.

Important Information
Ensure you have reviewed all requirements. By signing this Agreement, you confirm you understand and agree to abide by all terms, and that failure to meet any requirement may void the rental.

You acknowledge and agree that you are fully responsible for any claims or damages involving third parties (e.g., other drivers, pedestrians, property owners) resulting from your use of the rental vehicle. TCR is not responsible for any third-party damages or injuries caused by you or additional drivers listed on this Agreement.

______  Indemnification and Waiver
You agree to defend, indemnify, and hold TCR harmless from any claims, damages, liabilities, injuries, losses, costs, or expenses arising out of your use of the rental vehicle, including any third-party claims for property damage or personal injury. You may seek coverage from your personal insurance, but you remain ultimately responsible to TCR for any losses. You waive any claims for incidental, special, or consequential damages related to this rental.

 _______ By signing this document, you acknowledge that you have read all pages, understood, and accepted all terms and conditions of this Rental Agreement.
